When a return is realistic
- Defect or mismatch. The bottle leaks, the liquid is cloudy, the smell is clearly spoiled, the batch code is unreadable. In Russia that is goods of improper quality, and a return or exchange sits under article 18 of the consumer protection law. Other countries have a similar defect path. The paperwork differs.
- A fake. If you have grounds to call the item counterfeit. Harder: you may need an expert. Filing the claim still starts the process.
- Late delivery, or a shop that will not fulfil the order. That dispute is about the contract.
- A sealed box. Some shops take a sealed item back as a courtesy, under their own policy. Read it before you buy.
If you are in a dispute
- Film the unboxing. Camera on as you open the parcel. Capture the batch code, the bottle, the box.
- Write a claim. Email and messenger. Say what is wrong, what you want (refund or exchange), and a reply window. In Russia the legal window on a claim is 10 days.
- An expert check. If the shop refuses a defect return, Russian law says the shop pays for the examination and you may attend. Elsewhere, ask for the same in writing before you ship the bottle back.
- A regulator, then a pre-court letter. In Russia, Rospotrebnadzor. Movement often starts once a prosecutor and a court are named. Use the equivalent consumer body where you live.
- Court is the last step. Under Russian consumer law you can also claim a penalty and a 50 percent fine on the sum. Local rules differ.
What actually happens
Shops often cite “smell is subjective” and refuse. That argument holds if your claim is “I do not like it”. It fails if your claim is a defect or a fake. The difference is the wording and the evidence.
Decants, storage, concentration
A decant from a seller with a record is cheaper than returning an opened bottle. Confirm the concentration before you open anything: a wrong EDT in an EDP box is a mismatch, and a bottle cooked in a hot van can smell “off” with no counterfeit involved. Photograph the liquid and the code while it is still cold from transit.
